Lost God Art – Terms of Service 

 

These terms of service englobe all works commissioned from Lost God Art (digital artist). By commissioning work, the commissioner (client) agrees to these terms of service. The date of agreement corresponds to the date of submission of the order form. These terms of service govern the respective rights of Lost God Art and the commissioner with respect to the artwork commissioned as detailed in the submitted order form.

I – General Terms

 

Prices are subject to change based on demand. Lost God Art has the right to reject any order for any reason.

II – Payment 

 

All payment will occur through PayPal and are accepted in either USD or CAD. Commissions below $100 CAD are to be paid 100% up front. Commissions above $100 CAD can be paid either 100% upfront or split 50% upfront and 50% after sketch approval pending agreement between Lost God Art and commissioner. 

 

No payment will be accepted until approval of the submitted order form and agreement of Lost God Art to complete the commission work.

III – Process and Delivery

 

Commission completion varies between 1 week to 3 months depending on factors such as health, the complexity of the commissioned piece, and other work. 

 

Drafts/mockups will be supplied throughout the process, and work on the commission will continue pending acceptance from the commissioner. The number of drafts/mockups is dependent on the complexity of the commission. A final sketch will also be supplied for acceptance. 

 

Upon completion of the commission the commissioner will receive a full-resolution file (JPEG or PNG file type) of final drawing and a smaller version for internet upload. Note that there is no physical product.

IV – Revisions

 

Communication throughout the commission process is expected of both parties to achieve a satisfactory final product. This includes providing references and clear descriptions of the requested product. 

 

Unless a misunderstanding on behalf of Lost God Art has occurred, any changes requested on the final drawing will incur an additional fee to cover the hours of work to fulfill this. If a change is asked after approval of the commission order form, a revision of the price and additional charge might be incurred in order to reflect the changed commission. This price is based on an hourly wage.

V – Copyright

 

             Lost God Art (artist)

 

Lost God Art reserves the right to cancel and refund the order at any time for any reason. 

 

Lost God Art retains all copyrights over the commissioned artwork.
 

Lost God Art will not claim the intellectual property (IP) of the commissioned artwork.
 

Lost God Art reserves the right to post the commissioned artwork and production process online, in a portfolio, as well as in publications such as art books.

 

            The commissioner (client)
 

The commissioner may upload the commissioned artwork on any website and social channels.
 

The commissioner may not make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.) The commissioner may not use the commissioned artwork for commercial purposes.
 

The commissioner may not alter the commissioned artwork without the consent of Lost God Art.
 

The commissioner retains the rights to the intellectual property (IP).

 

The following is considered copyright infringement:​
 

• Reproducing/using the copyrighted artwork commercially
   

• Claiming the artwork as the commissioner’s own
   

• Altering the artwork without the artist’s consent

VI – Cancellation and Refund Policy

 

No refunds will be issued once Lost God Art has begun work on the commission. If the commission cannot be started, a full refund will be issued to the commissioner. If the order is cancelled before work has begun, a full refund will be issued. 

 

If a PayPal chargeback is requested at any point without permission, the commissioner will lose all beforementioned rights to the commissioned piece. The chargeback will be declined and Paypal will be supplied with both the terms of service and the order form acting as proof of commission. 

 

The commissioner will furthermore be black listed.
